Terms of Service
1. COMMISSION TERMS
Before proceeding, please read the commission terms. By requesting a commission, I assume that you have read, understood and agreed to all the terms and conditions below.2. SUMMARY OF THE STEPS
2.1. You send a commission request by form or messaging me through my main social media (Discord or Telegram preferred, but I have other options if needed). We talk about the concept you want, the characters reference sheets and details, then I will accept or reject the commission.
2.2. If the commission is accepted, I will ask for the payment.
2.3. After confirming the payment, I will send you the first sketch during the time frame of one week. If something happens and I can't meet that time frame, I will keep you updated. The work in progress follows a specific schedule described below and I will only proceed to the next step when the previous one is approved. When approved, I will send you the final and full image file, and you cannot claim any modifications without paying extra taxes or refunds.
2.4. The final file is a PNG/RGB image, in a size I chose or a size you specify. It will be available for you for personal use only and you cannot modify it.3. GENERAL RULES
3.1. All communication must be respectful and focusing on the commission. I don't mind chatting outside of that but I will treat you with respect and I expect you to do the same. I will quit the negotiations at any moment, not providing refunds, if these rules are not followed.
3.2. My working days are Monday to Friday. Feel free to message me at any time, but I will be more likely to answer during these days. Please don't over message though, much appreciated!
3.3. Please be aware that I will do my best to translate the specifications of any commission in my own style. If you are searching for another style, please consider commissioning another fellow artist.
3.4. Please be aware that I choose my commission requests, and may refuse some of them.
3.5. If you are less than 18 years old, I will only make you SFW art.
DO NOT try commissioning NSFW art from me! Ignoring this will result in me stopping the work on your drawing and denying your future commissions!
3.6. At any moment in the future, I may update my terms and prices if needed.4. LANGUAGE
4.1. All commission and discussion is to be held in English.5. ABOUT THE COMMISSION REQUEST
5.1. Please provide clear and direct references, both text and images. If there isn't a clear reference and I end up needing to keep checking on you for extra info, the commission might end up being delayed.
5.2. Please let me know if you want to remain anonymous at the start. I will respect that.
5.3. In case of Your Character Here (YCH) commissions, if your character is very complex or original lines will be heavily changed, I will charge an extra fee.
5.4. Upon acceptance of the commission, it is a mandatory requirement for you to send me an email that includes the reference sheet/sheets for the commissioned work and short description of what you would like me to draw for you. The email address used for this submission must match the PayPal email address provided during the payment process. I will not accept your commission if this is not fulfilled.
By sending me this email, you confirm that you have read and agreed with these terms of service.6. PAYMENT DETAILS
6.1. After confirming that I accept the commission, I will ask for the payment. I have PayPal available for that.
6.2. I work with upfront payments. I will only start working on your drawing after receiving the payment.
6.3. For commissions exceeding $150, a payment plan can be arranged. The payment plan will consist of 2 installments, with 50% due before starting and the remaining 50% upon completion. Specific deadlines for each installment will be agreed upon during the commission acceptance phase.7. WORKFLOW AND EDITS
7.1. Please follow the steps and provide feedback to keep the workflow smooth.
7.2. All the WIPs come in low resolution and may have watermarks.
7.3. You cannot use WIPs or its modified versions in any way and they are not for any public or private use outside our communication.
7.4. The workflow is the following:
---7.4.1. Step#1: sketch. You can ask for up to 3 edits, respecting the range of the references and specifications. The result is a clean sketch that will be the base for the final work.
---7.4.2. Step#2: lineart and coloring. You can ask for up to 3 edits, respecting rigorously the clean sketch. Any extra changes will be charged.
7.5. You agree to provide timely feedback and approvals during the workflow to avoid delays. I will not move onto the next step without the approval of the previous one and likewise, requesting changes of previous steps will come with a fee.
7.6. I usually take 3 to 7 business days (Monday to Friday) to complete each step or edit. I cannot draw every single day due to personal reasons, but I will let you know if I have to change my working schedule. If you have a deadline, please let me know in advance so we can discuss it.8. WHAT I CAN DRAW
8.1. Non-human animals or mythological animal beings and hybrids, but other are welcome too if provided fair references.
8.2 Details around the character, like flowers, fruits, objects, clothing or furniture, also extra.
8.3. SFW furry/anthro.
8.4. Suggestive/NSFW content - anthro only - ask first!9. WHAT I WILL NOT DRAW
9.1. Hate speech and anything oppressive (racism, misogyny, antisemitism, pedophilia, zoophilia, anti-LGBT, ableism, fat-shaming, etc) gore or heavy gore or hard fetishes.
9.2. Won't draw, for skill/stylistic reasons: humans and humanoids, MLP and Sonic characters.10. MAIN REASONS TO QUIT THE COMMISSION WITHOUT REFUNDS
10.1 If you, the commissioner, at any moment, lack respect or communication (not communicating for more than 30 days), I will quit the commission without refunds.11. POSSIBLE REFUNDS
11.1. I select commissions with care to minimize the risk of abandonment during the workflow. I value honest communication, and I will consider refunds only in the following circumstances:
---11.1.1. Personal Emergency: If I, before starting the work or while in the process, encounter a personal emergency that prevents me from completing the commission, a refund may be considered.
---11.1.2. Sketch Phase Completion: Refunds will be entertained only until the completion of the sketch phase. Once the sketch has been finalized and the subsequent stages initiated, refunds will no longer be applicable.
In the case that you cancel the commission before the lines and coloring phase, I retain the rights to use the sketch for other commissions or other artistic purposes.
Honest and timely communication is crucial in such situations.12. SPECIFICATIONS OF THE DRAWING
12.1. It is a digital illustration. The format is PNG, the color is RGB and size of the drawing is either specified by you or left to me to decide.
12.2. Do not mint it into NFTs, nor use it in A/I art software (check also item 12.4.)
12.3. These commissions are for personal use only. You can post it only in your personal accounts while giving the proper credits and a link to https://enderpotato.carrd.co/ and/or any of my other galleries. If you have any other needs, please let me know in advance so we can discuss it.
12.4. You cannot modify the final file in any way. If you need to modify the file or this usage, please contact me to negotiate.
12.5. I own the rights of the drawing; so I can post it (and post the WIPs) to my galleries at any time, unless previously agreed otherwise.If you decide to commission me, I will try my best to produce a result with which we are both happy!
